Liquid cargo duty to be levied on basis of shore-tank receipt

THE long-pending dispute over whether the ship ullage survey report or the shore-tank receipt should be taken as final for determining the quantity of imported liquid bulk cargo to levy customs duty has now been settled in favour of the latter.

As per Customs circular 96/2002 dated December 27, 2002, issued by the liquid cargo, quantification of bulk liquid cargo for the purpose of assessment should be done on the basis of shore-tank receipt, that is dip measurement in tanks on shore into which such cargo is pumped from the tanker.

The decision of the follows the Supreme Court judgment dated February 20, 2002 in case of Commissioner of Customs (Import), Mumbai vs NOCIL (National Organic Chemicals Industries Ltd), wherein the apex court set at rest the dispute by ruling that customs duty should be demanded on the quantity that is pumped into the shore tanks. In case of assessment of bulk liquid cargo which is not discharged through regular pipelines but cleared directly on payment of duty, that is without the cargo being warehoused in a shore tank, assessment may continue to be done as per ship's ullage survey report, the circular has clarified.

What happens to the liability of the Master/Agent for penal action for shortages? The liquid cargo is of the view that the liability of the Master/Agent for penal action under section 116 of the Customs Act, 1962, should continue to be determined by comparing the ship's ullage quantity at the port of discharge with the ship's load-port ullage quantity or the Bill of Lading quantity, if the former is not made available by the Master/Agent.

The circular, although belated, has been widely welcomed by industry and trade circles. Liquid bulk imports comprise mainly petroleum products, vegetable oil, chemicals and industrial oils. A number of corporate decision-makers this correspondent spoke to hailed the move as being practical and wholly justified. "The Government has at last corrected the mistake it committed a few years ago when it resorted to the imperfect and generally inaccurate ullage method by discarding storage tank weighment. In the new dispensation, we can expect a fair and equitable treatment of liquid bulk imports from the customs authorities," an industry spokesman said.

Talking to Business Line , , President of the liquid cargo and , who had spearheaded the movement for restoration of status quo ante, said the Government move was welcome, but some practical difficulties still remained. "While shore-tank weighment is good for liquid bulk cargo discharged into storage tanks, there is a large number of cases of importers discharging the cargo directly on to tank-lorries and transporting the material. In such cases too, ullage method should not be applied, but tank lorries should be weighed inside the port premises under customs supervision and the quantity determined accordingly," Mr Lapsia remarked.

Suggesting that in revenue matters nothing should be left to chance or no inaccurate method should be adopted, the association President stated that proposes to make a representation to the Government to further fine-tune the system of quantifying imported liquid bulk cargo, taking into account all situations including direct discharge into tank lorries.
